Terms & Conditions
Last updated: 10 June 2025 · Effective: 10 June 2025
These Terms and Conditions ("Terms") govern your use of the website at dayaciptads.world and your enrolment in courses offered by Daya Cipta Sdn Bhd ("Daya Cipta", "we", "us", "our"). By accessing the website or enrolling in a course, you agree to be bound by these Terms. If you do not agree, please do not use our services.
1. Definitions
"Agreement" — these Terms and Conditions, together with any enrolment confirmation.
"Course" — any online learning programme offered by Daya Cipta, including Starting Out in AI, Hands-On Machine Learning, and Shipping Real AI Applications.
"Content" — all lesson recordings, written materials, code templates, exercises, and other resources provided as part of a Course.
"Learner" / "You" — any individual who enrols in or accesses a Course.
"Platform" — the online systems through which Course content and community features are delivered.
2. Acceptance of Terms
By completing enrolment and payment, you confirm that you are at least 18 years of age, have the legal capacity to enter into this Agreement, and accept these Terms in full. Parents or guardians wishing to enrol a minor should contact us directly before proceeding.
These Terms apply in addition to any specific conditions stated in your enrolment confirmation email.
3. Course Description and Availability
Daya Cipta offers online AI development courses delivered via structured cohorts. Courses include recorded lessons, weekly live sessions, mentor feedback, and access to a community space for the duration of the cohort.
Course availability is subject to minimum enrolment numbers and scheduling. We reserve the right to reschedule or cancel a cohort if minimum numbers are not met, in which case enrolled learners will receive a full refund or the option to transfer to a future cohort.
Courses are available primarily to residents of Malaysia but may be accessed from other countries where local law permits. It is your responsibility to confirm that accessing the course does not breach any applicable local regulation.
4. Learner Account
You will be provided with access credentials for the learning platform upon enrolment. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Do not share access with others — course access is issued per individual.
If you suspect unauthorised use of your account, notify us at [email protected] immediately.
5. Learner Responsibilities and Acceptable Use
You agree to use course materials and community spaces respectfully and in accordance with their intended purpose. You must not:
- Share, redistribute, or resell any course content without written permission
- Record live sessions without instructor consent
- Harass, abuse, or disrespect other learners or instructors in any community or live session space
- Submit work that is not your own as original work for feedback
- Use course materials or community access for any unlawful purpose
We reserve the right to remove learners from the community space or course access for breach of these conduct requirements, without refund.
6. Intellectual Property
All course content — including lesson recordings, written materials, code examples, and templates — is the intellectual property of Daya Cipta or its instructors. Enrolment grants you a limited, non-exclusive, non-transferable licence to access and use materials for your own personal learning during the cohort period.
You may retain and use project code and outputs you develop as part of your coursework. However, you may not reproduce, distribute, or commercially use course instructional content without prior written consent from Daya Cipta.
7. Payment Terms
All fees are quoted in Malaysian Ringgit (RM). Current course fees are:
- Starting Out in AI: RM 235 per enrolment
- Hands-On Machine Learning: RM 283 per enrolment
- Shipping Real AI Applications: RM 329 per enrolment
Payment is required in full before access is granted. We accept online bank transfer, credit/debit card, and selected e-wallet providers. Fees are subject to change; any change will not affect confirmed enrolments.
Refund Policy
- Full refund if requested more than 7 days before the cohort start date
- 50% refund if requested within 7 days before the cohort start date and before the cohort starts
- No refund once the cohort has commenced, except where Daya Cipta cancels the cohort
Refund requests should be submitted to [email protected].
8. Course-Specific Terms
Access duration: Course content, recordings, and community access are available for the duration of the cohort. Post-cohort access arrangements (if any) are communicated in your enrolment confirmation.
Completion records: Learners who engage with core course activities are eligible for a completion record. We do not issue accredited qualifications or degrees. Completion records are internal to Daya Cipta and confirm participation, not a standardised assessment outcome.
Academic integrity: Submitted assignments must represent your own work. We may decline to provide feedback on work that appears to have been produced by automated tools without your meaningful input or reflection.
Scheduling: Live session times are set at cohort start. We make reasonable efforts to provide recordings of sessions you miss, but cannot commit to rescheduling sessions for individual learners.
9. Disclaimers
Courses are provided "as is". While we work to maintain content accuracy and quality, we make no representations about the completeness or fitness for any particular purpose of the course content.
We do not represent that completing any course will result in employment, career advancement, or any specific professional outcome. Learning outcomes depend substantially on individual effort, prior experience, and application of learning.
Course content does not constitute professional, legal, or financial advice.
10. Limitation of Liability
To the extent permitted by Malaysian law, Daya Cipta's total liability to you for any claim arising from or related to a course shall not exceed the amount you paid for that course.
We shall not be liable for indirect, incidental, or consequential losses, including loss of earnings or opportunities, howsoever arising, unless caused by our gross negligence or wilful misconduct.
We are not liable for service interruptions caused by factors outside our reasonable control, including internet outages, third-party platform failures, or force majeure events.
11. Indemnification
You agree to indemnify and hold harmless Daya Cipta, its instructors, and staff from any claims, losses, or expenses arising from your breach of these Terms, your misuse of course materials, or your violation of applicable law in connection with your use of our services.
12. Termination
We may suspend or terminate your course access if you breach these Terms, including conduct violations or non-payment. Where termination is due to a breach by you, no refund will be provided.
You may withdraw from a course at any time, subject to the refund policy in Section 7. Withdrawal requests should be made in writing to [email protected].
Sections 6 (Intellectual Property), 9 (Disclaimers), 10 (Limitation of Liability), and 13 (Dispute Resolution) survive termination of these Terms.
13. Dispute Resolution
These Terms are governed by the laws of Malaysia. Any dispute arising from these Terms or your use of our courses shall be subject to the exclusive jurisdiction of the courts of Malaysia.
Before initiating formal proceedings, both parties agree to attempt to resolve any dispute through good-faith discussion. You may contact us at [email protected] to initiate that process.
14. General Provisions
Entire Agreement: These Terms, together with your enrolment confirmation and our Privacy Policy, constitute the entire agreement between you and Daya Cipta in relation to your course enrolment.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
Waiver: Our failure to enforce any right under these Terms does not constitute a waiver of that right.
Assignment: You may not assign or transfer your enrolment or rights under these Terms without our prior written consent.
Notices: Formal notices from you to Daya Cipta should be sent to [email protected] or to our registered address.
15. Changes to These Terms
We may update these Terms from time to time. We will notify enrolled learners of material changes by email at least 14 days before the new terms take effect. Continued enrolment in or access to courses after the effective date constitutes acceptance of the updated Terms. The current version is always available on this page.
